Our firm rarely litigates but we do lend our securities experience to assisting stock market customers with arbitrating and/or otherwise seeking to settle securities investment concerns such customers have with their participating brokers. Securities Arbitration and Mediation has embarked on a streamlining campaign. The NASD and the NYSE Arbitration regulatory units have combined to form FINRA. Procedures utilized within this Arbitration forum have a flexibility and more user-friendly , expedited character, from the litigation realm, that invites the customer's 'story' to be heard without being overburdened with the lawyering underlying an active motion practice. There is an ease of procedure to bring a client's case before the Arbitration Panel that assists greatly in having a claim considered timely and efficiently with full force of law but without most of the many technical roadblocks encountered in litigation and resulting time consumption. With brokerage firms now conforming to set fee periodic management compensation arrangements as versus the historical commission driven system - common claims from the past for churning and other commission driven complaints have diminished recently but suitability problems continue to exist and be actionable. The 'Know Your Customer Rule" is alive and well and the Shingle Theory whereby the brokerage community is considered and presumed to accept and acknowledge the risks inherent in the trust relationship they invite, remains intact. Arbitration can be a realistic alternative to litigation. In the regulated stock brokerage world arbitration is mandatory for the brokerage community and encouraged but not obligatory on the customer. Our U.S. Supreme Court has proclaimed and recognized the important role Arbitration plays in Securities disputes. Where the customer chooses to accept Arbitration we can be there to help.
