Our firm does periodically handle litigation on a very limited basis basically provided such litigation is associated with other services we have rendered for the client and therefore where we feel that we have a special familiarity with the subject matter of the litigation that gives us an advantage in processing such litigation, an example being litigation that may be associated with particular contracts that our firm has assisted the client in establishing.
We have among our myriad of business clientele, a core of vehicle sales businesses. We have provided continuous assistance to these clientele in the areas of both business organization and contract work, as well as lemon law defense matters. We are predominantly a business transactional firm and that litigation which we do handle usually is an adjunct to our transactional matters and associated therewith by way of we having established the contract basis for defense of claims against our business clientele. We do not handle litigation on a routine basis but we are confident in our handling of the limited defense work that we do because it is us who have developed the contracts which form the parameters within which the claims we handle are usually situated. Because of a positive experience it has been suggested to us by a well respected client that we offer a regimen to other business similarity situated to that of such client that would involve our reviewing and, where we find it necessary, for us to revise current relevant contracts and establish other additional contracts in an effort to bolster a client's chances of success against claims which may arise from customers and which can be argued as governed by the contracts which we endorse for the client. There has been judicial recognition of the effectiveness of the contract language we have established for recent clients.
The basic structure of our plan to attempt a minimizing of potential litigation costs for our potential clients who choose to consider utilizing our services is to charge a fee for establishing the contracts which will establish the basis of our confidence in handling consumer complaints for the client which would arise therefrom, and thereafter for an agreed period of time have the client retain our offices on a monthly flat fee basis to handle the relevant litigation that may arise, if and when it may arise, on a significantly reduced hourly fee. Costs in addition to legal fees shall remain the responsibility of the client to satisfy and the litigation, for which we will agree to be retained to handle, must arise within the context of the contracts that we suggest and with compliance by the client in the structure and use of the contracts.
